Under the new policy Immigration New Zealand (INZ) have made it clear that they will be calculating the rate of pay based on the applicable hourly rate. If your Employment Agreement provides an annual salary, then INZ will divide the annual amount by the number of weeks (52), and then by the number of hours mentioned in the agreement. If your agreement states "30-40 hours" then they will calculate the hourly rate based on the highest amount (40). If instead your agreement provides an hourly rate, then you can simply ignore the annual amount of $41,538. In that case, as long as your hourly rate is higher than $19.97 per hour, and you have a guaranteed number of hours more than 30 per week, then you will be considered to meet that pay rate. In other words, focus on the actual hourly rate, and not the total annual amount.

As an extra comment, INZ have also made it clear that when a person is on salary, and the agreement requires them to work additional hours above their normal working hours, they will likely ask employers for clarification of the maximum number of hours. If the maximum is too high then a salary-earner is at risk of being below the required hourly rate.

but i have another questions about your extra comment haha..
If when a person is on salary, and the agreement requires them to work additional hours above their normal working hours,but the person will be given the extra cost about the extra hours, doesn't it matter what you mentioned at the bottom?

and about the Skilled Migrant Category, if I earned $23.49 per hour but if can't get $48,859 per year, like only 30~40 hours,
is it still available to apply for the SMC ?
or Do i have to get at least $48859 per year for the SMC?

Hi Darby,

You should be certain that your actual hourly rate meets the requirements. The current minimum amount is now $24.30 per hour after 15 January 2018. If you work overtime then you should be paid the same rate.

If you are only working 30 hours then that is ok. But your hourly rate must meet the requirement of $24.30 per hour (it has increased since 15 January 2018). So 30 hours for 24.30 equals only $37,908. This would be ok for residence. The main point is the hourly rate.

기존 관점은 두가지 모두 충족되어야 한다는 것이었는데..

The key figures that we need to remember are only $23.49 per hour and 30 hours per week which are the minimum pay and hours in ALL situations (increased to $35.24 for level 4 or 5 jobs). Let's not get confused by the annual income as they are actually irrelevant (although mentioned by the manual) to the definition of skilled employment.
